HOURS OF SERVICE
Cyberside Rescue Service is provided Monday - Friday from
9:00 AM to 6:00 PM Eastern Standard Time, excluding Fourth of July, Thanksgiving, Christmas Eve/Day, and New Year's
Eve/Day when no service is provided.
SPECIAL HOURS
Special hours may be arrange for critical needs.
There may be additional fees for this service.
COMPUTER REQUIREMENTS
Windows based PC running Windows 98 or above.
SOFTWARE REQUIREMENTS
Anti Virus software and a "firewall."
If these are not present at the intitiation of service, we will direct you the FREE acquisition of this software. If
necessary, we step you through the installation.
PC-To-PC software. Cyberside Assistance is provided
remotely, with our visiting your computer via the Internet. It is necessary for you to have software installed that
will allow this. Windows XP has this provision built in... but it must be activated. If you are not runing
XP, you will download this software when we initiate service.
SERVICE INITIATION -- "Vetting"
In essence, Acing Evil's Cyberside Rescue
Service is an HMO where we provide both the insurance and the cure. So, as any insurance company, we ask for the
right to inspect computers that may have been previously infected... are infected... or have cobbled together with several
softwares that may be contending poorly for the control of your system's security.
TERMINATION -- By You
You may terminate this service at anytime. You will
be refunded a pro-rated amount, which will be calculated by month as of the first of the month, to determine your refund.
NOTWITHSANDING... IF YOU HAD CALLED OUR RESCUE SERVICE AND BEEN ASSISTED BACK
TO A VIRUS-FREE OPERATIONAL LEVEL (LESS REPAIRS TO FILES AS MENTIONED BELOW) YOU AND ACING EVIL MUTALLY AGREE THAT
YOU HAVE RECEIVED FAIR VALUE FOR THE SERVICES RENDERED AND THAT THERE IS NO REFUND DUE.
TERMINATION -- By Us
We may terminate this service if in our objective judgement,
you have not / are not implementing both the "best practices" procedures and software which we recommend. Acing
Evil's Cyberside Rescue service is designed for and provided to clients whose PCs and the contents therein
are valuable to them. We are not a drop-in clinic for dangerous cyber lifestyles!
OUR LIMITS TO LIABILITY
Acing Evil attempts to protect your computer through
knowledge, human engineering, and software... three variables over which we have little control once dispensed. We also
agree through this service to "rescue" you should all else fail... "rescue" being defined to mean that we will restore
your computer to a virus-free operational status with your firewall reinstalled.
THIS DOES NOT MEAN THAT THIS SERVICE MAY OR WILL BE ABLE TO RESTORE
ALL OF YOUR FILES, INCLUDING E-MAIL, DOCUMENTS AND GRAPHICS THAT WERE INFECTED. FOR THIS REASON, WE STRONGLY RECOMMEND
YOUR "BACKING UP" CRITICAL DATA.
IN NO CASE WILL WE BE RESPONSIBLE FOR MORE THAN
THE FEE FOR THE SERVICE SHOULD WE NOT PROVIDE RELIEF AS STATED IN THIS PARAGRAPH.
MAJOR FORCES
Acing Evil cannot be responsible for not providing its described
services for delays caused by major forces, including, but not limited to God, Nature, War, Terrorism... including Hacker(s)
who may surreptitiously infect or "bomb" (busy-out) the
entire Internet. Should such a Major Force occur, which does not leave Acing Evil permanently debilitated,
it will resume business as soon as possible and will work to restore its clients as discussed in Fees & Services,
Description.
